The Politics of Juridification offers a timely contribution to debates about how politics is being affected by the increasing relevance of judicial bodies to the daily administration of Western political communities. “Juridification” meaning: the manufacture of laws and legally enforceable non-law norms—especially contracts binding consumers to terms set in boilerplate language dictated by corporations. At first glance no puzzle is apparent. Here, too, juridification takes on deeply negative connotations. Kirchheimer had, as we have seen, narrowed the juridification concept to apply to the phenomenon of the Weimar Republic and, thematically, to (labour) law and politics. Further, developing this thematic concept, Habermas generalises the notion of juridification in two ways.

The authors distinguish between five dimensions of “juridification”; constitutive juridification, juridification as law’s expansion and differentiation, as increased conflict solving with reference to … definition.
