The Politics of Juridification offers a timely contribution to debates about how politics is being affected by the increasing relevance of judicial bodies to the daily administration of Western political communities. “Juridification” meaning: the manufacture of laws and legally enforceable non-law norms—especially contracts binding consumers to terms set in boilerplate language dictated by corporations. At first glance no puzzle is apparent. Here, too, juridification takes on deeply negative connotations. Kirchheimer had, as we have seen, narrowed the juridification concept to apply to the phenomenon of the Weimar Republic and, thematically, to (labour) law and politics. Further, developing this thematic concept, Habermas generalises the notion of juridification in two ways.

The authors distinguish between five dimensions of “juridification”; constitutive juridification, juridification as law’s expansion and differentiation, as increased conflict solving with reference to … definition. Juridification means not only that a given right, process or activity can be referred for protection or definition to a duly constituted adjudicative body, but also the creation of the body itself, i.e. the creation of the laws and regulations to which the body refers, the process by which it becomes accepted that such a body is the juridification the process whereby the law has come to exert an increasing influence on the employment relationship and the conduct of industrial relations.
